Appellate court upholds the election of Mbeere South MP

The Court of Appeal has upheld the election of Geoffrey King’ang’i as Mbeere South MP.

While dismissing the case, the court noted that claims of bribery and witchcraft by the petitioner Mr Peter Kamau Nyutu went unproven.

Mr Nyutu had claimed that the MP bribed voters, used witchcraft to bind voters before the elections and that the petitioner’s agents were denied access to the polling stations.

One of the petitioner’s witnesses Kevin Murimi told the court that the MP used two witch doctors to administer the ritual on July 22.

However while dismissing the case, Justices Asike Makhandia, Fatuma Sichale and Sankale ole Kantai said none of the allegations were proved.

The judges further faulted Nyutu for failing to file a proper notice of appeal. Mr Nyutu filed his petition at the High Court in Embu instead of the court’s registry in Nairobi.
